Formal request shall be addressed to the Office of the Prosecutor General that is entitled to decide on taking over the criminal proceedings.
According to the HU legislation, the criminal proceedings may be taken over from a foreign state, where it is expedient to carry out / continue with the proceedings in Hungary, by taking into account, in particular, the place of perpetration, the defendant’ actual place of residence and the victim’s interests.
