The Metropolitan Chief Prosecution Office of Budapest shall have the competence and jurisdiction to receive notification from the competent authority of the intercepting Member State on intercepting and recording the communication (by means of an electronic communications service or information system) of a person staying in the territory of Hungary, without the knowledge of the person concerned and without the technical assistance of Hungary.
The notification shall be received in the form of Annex C in Hungarian, or by using a translation of the form available in English, French or German.
After having received the notification, the Metropolitan Chief Prosecution Office of Budapest shall immediately examine whether the conditions, that are set forth in our rules for covert investigative measures, are fulfilled in respect of the procedural act planned, performed or completed by the authority of the intercepting Member State. The prosecution office, in case where the interception would not be authorised in a similar domestic case, notify, without delay and at the latest within 96 hours after the receipt of the notification, the competent authority of the intercepting Member State.
