Measure Implementation

Is this measure possible in your Member State under International Judicial Cooperation?

Foreign authority may continue - in the frame of law enforcement cooperation - the surveillance affecting the person suspected of having committed a crime and the person who is associated with him, that started in its national territory with the prior consent of Center for International Cooperation in Criminal Matters (NEBEK). In urgent cases it is possible to proceed without such authorization, but the foreign authorities must inform NEBEK immediately after crossing the state border and request for assistance must be sent without undue delay. Surveillance is admissible if there is a reasonable suspicion of that serious crime having committed, or when Article 40 of the Convention Implementing the Schengen Agreement and the Naples Convention II make it possible. The observation must be finished immediately after the competent Hungarian authority requests its termination, or in case the authorization is not granted within 5 hours after crossing the state border.
