Procedural documents may be sent directly by the foreign authority to the person concerned by post as registered mail. Procedural documents may only be delivered through the judicial authorities of Hungary as a service of process in the frame of mutual legal assistance, if: (a) the address of the addressee is not known; (b) delivery via post was not possible or (c) there are justified reasons for considering that delivery by post will be ineffective or is inappropriate; (d) the addressee has been kept in detention. The procedural document to be served in the frame of MLA should be accompanied with a translation – if the addressee does not know the requesting state’s official language – into the addressee’s native language or one of the languages he knows, or - if these are not known before the requesting judicial authority – with a translation into Hungarian. Information on the addressee’s procedural rights an obligation should be annexed to the procedural document to be served.
