Prosecution service(’s designated unit) is entitled to authorize and execute an EIO/ MLA request aiming at the deployment of a MS’s undercover officer in the territory of Hungary, or a Hungarian undercover officer in the territory of Hungary or another Member State.
The deployment requires an ad-hoc agreement. In urgent case, exceptionally, without an ad-hoc agreement, the deployment of a MS’s undercover officer in the territory of Hungary may be authorized by the head of the designated investigating authority for a period of 24 hours, but the prosecutor’s permission shall be obtained without undue delay. If the prosecutor subsequently refuses to authorize the deployment, its result cannot be used as evidence, and the issuing authority shall be notified thereof without delay.
