Measure Implementation

Is this measure possible in your Member State under International Judicial Cooperation?

Cooperation for controlled delivery can be initiated in the frame of EIO/MLA. County chief prosecution offices (or Metropolitan Chief Prosecution Office of Budapest) alongside the planned route of the controlled delivery have competence and jurisdiction for executing the EIO. An ad-hoc agreement with the issuing authority needs to be reached for the execution. During the execution in the territory of Hungary – including its direction and control – the Hungarian law shall be followed. The issuing authority’s any request concerning the execution of the controlled delivery may only be fulfilled, if it is not contrary to the basic principles of the Hungarian legal system. Foreign officer may take part in the escort of the consignment with the authorization of the prosecution office. Cover officer may only participate in the escort of the consignment in accordance with the rules of application of cover agent.
