Is this measure possible in your Member State under International Judicial Cooperation?

Where a pecuniary confiscation order has been issued or is likely to be issued against a person by a criminal court of a foreign state, a restraint or freezing order may be issued upon request of an authority of that state, where there is reason to suspect that the person attempts to conceal his assets or otherwise avoid payment. The measure may however not be used where not permitted under Finnish law, had the offence been committed in Finland under similar circumstances, unless otherwise is stipulated in the regulation 2018/1805 or framework decision 2003/577/JHA.

Concise legal practical information

Special requirements

Regulation: no set period of validity When the framework decision 2003/577/JHA is applied, the prosecutor shall set a period of validity for the measure. The deadline may be extended at the request of the issuing authority of the freezing order.
