Hearing a witness or a party in pre-trial investigation or in court by means of a video conference. A defendant may be heard in a trial by way of a video conference. Consent is needed.

Legal Framework

International legal framework applicable for this measure in your Member State

Directive 2014/41/EU of 3 April 2014 regarding the European Investigation Order in criminal matters MLA 2000 Convention. A video conference may be set up pursuant to Article 10 of the Convention when hearing an injured party. The measure may be used both in pre-trial investigation and during court proceedings. In relation to Member States not applying the EIO Directive or the Convention, the measure is executed pursuant to Finnish law or following a particular procedure specified in the request (if not against ordre public)
