Is this measure possible in your Member State under International Judicial Cooperation?

Hearing a witness or a party in pre-trial investigation or in court by means of a telephone conference. Hearing a suspect by telephone is possible only in pre-trial investigaton, not in court proceedings. The investigator may allow the suspect to give his statement by telephone, where the case is of lesser importance and the suspect does not dispute the offence, or where the statement merely complements a previously given statement.

Legal Framework

International legal framework applicable for this measure in your Member State

Directive 2014/41/EU of 3 April 2014 regarding the European Investigation Order in criminal matters. MLA 2000 Convention. A telephone conference may be set up pursuant to Article 11 of the Convention when hearing an injured party. The measure may be used both in pre-trial investigation and during court proceedings. In relation to Member States not applying the EIO Directive or the Convention, the measure is executed pursuant to Finnish law or following a particular procedure specified in the request.
