Is this measure possible in your Member State under International Judicial Cooperation?

The Public Prosecutor has the competence to decide about the granting of requests to institute criminal proceedings which are sent to him/her on the basis of article 6 of the EU 2000 Convention. The Minister of Justice (AIRS) is the central authority designated according to the 1972 Convention.

International legal framework applicable for this measure in your Member State

- EU Convention on Mutual Assistance in criminal matters between the member states of the European Union (29 May 2000), article 6; - European Convention on Mutual Assistance in criminal matters (Strasbourg, 1959), article 21; - European Convention on the Transfer of Proceedings in criminal matters (Strasbourg, 15 May 1972).

Competent Authority

* receive the request/decision for judicial cooperation

The regional Centre for International Legal Assistance - (IRC) are designated to receive the file and send it to the competent prosecutor of the local Public Prosecutors Office. The competent public prosecutor will decide on the request to take over the prosecution. They will treat the case as if it were a Dutch criminal file.
