Sweden allows foreign judicial authorities to hold a hearing by telephone with a person who are in Sweden without any formalities and without interference from Swedish authorities, if the person to be heard consents to the hearing.
If a foreign authority needs assistance with the hearing from the Swedish authorities, a European Investigation Order (EIO) or a request for Mutual Legal Assistance (MLA) can be made. If the EIO/MLA is regarding a hearing during the preliminary investigation, the EIO/MLA should be sent to a prosecutor. If the EIO/MLA is regarding a hearing before the court, the EIO/MLA should be sent to a district court. Please see Atlas for further contact details. An EIO regarding a hearing by telephone can be executed when it comes to a plaintiff/victim or a witness but not with a suspect/defendant.
A MLA regarding a hearing by telephone can be executed when it comes to a plaintiff/victim, a witness and a suspect/defendant as long as the person to be heard consents to the hearing. The consent should appear in the request.
