Is this measure possible in your Member State under International Judicial Cooperation?

• First of all, it is worth mentioning body inspection, which is ordered, with a reasoned decree, by the Judicial Authority (the Public Prosecutor, during the investigations, and the Judge, during the trial phase), when it is necessary to ascertain the traces and other material effects of the crime. Then, as to body search, it is worth highlighting that when there is well-founded reason to believe that someone conceals, on himself, the body of evidence or, anyway, things pertaining to the crime, a personal search is ordered, with a reasoned decree, by the Judicial Authority, which can proceed personally or arrange for the act to be carried out by judicial police officers delegated with the same decree. • No differences occur from a legal point of view. However, it is worth stressing out that both body inspections and searches shall be performed respecting the dignity and, as far as possible, the modesty of those who are subjected to them.
