Measure Implementation

Is this measure possible in your Member State under International Judicial Cooperation?

The Judicial Authority (the Public Prosecutor, during the investigations, and the Judge, during the trial phase) can request to everybody – either private individuals/entities or Public Institutions – to provide any kind of information, documents or objects, which it deems to be useful in order to ascertain the facts under investigation/prosecution/trial. Moreover, the said information, documents or objects can be provided, at their own initiative, by those who hold them. Finally, it is worth pointing out that the acquisition, even ex officio, of any document originating from the accused is always permitted, even if seized from others or provided by others.
