Is this measure possible in your Member State under International Judicial Cooperation?

The General Prosecutor´s Office of the Slovak Republic receives, collects, processes and ensures the exchange of information including sensitive information, keeps and stores documentation in its central Register of Sentences. The register contains information on persons lawfully sentenced in criminal proceedings. This information may serve for needs of criminal, civil and administrative proceedings and for the proof of integrity. The information may be provided to the courts and judicial authorities of other states in the form and the extent set by the international treaty binding upon the Slovak Republic. The Police keeps its own records necessary for fulfilling of their tasks.

Legal Framework

International legal framework applicable for this measure in your Member State

Directive 2014/41/EU regarding the European Investigation Order in criminal matters in relation to the Member States which have implemented the EIO Directive. European Convention on Mutual Assistance in Criminal Matters of April 20, 1959. Convention of 29 May 2000 on Mutual Assistance in Criminal Matters between the Member States of the European Union. Council Framework Decision 2009/315/JHA of 26 February 2009 on the organisation and content of the exchange of information extracted from the criminal record between Member States. In case of existence, the bilateral or other multilateral treaty covering the specific subject matter may be applicable.

Competent Authority

EIO - Regional Prosecutor´s Office in the territorial circuit of which the measure is to be carried out. If the subject of the EIO includes solely the investigative measure which is to be carried out by a court by reason of its applicability in the criminal proceedings in the issuing state, the competent authority is the District Court in the territorial circuit of which the investigative is to be carried out. MLA - District prosecutor´s office according to the place of residence of the requested person. If the place of residence is not known, General Prosecutor´s Office. Ministry of Justice of the Slovak Republic is the competent central authority for the transmission of the request for the mutual assistance.

Accepted languages for the request/decision

EIO – Slovak. The Czech Republic may send the EIO in Czech. Otherwise, official translation into the Slovak language is needed. When proceeding according to European Convention on Mutual Assistance in Criminal Matters of April 20, 1959, one of the official languages of the Council of Europe may be used. Language regime may be modified according to the relevant bilateral treaty.
