Council Framework Decision 2008/947/JHA of 27 November 2008 on the application of the principle of mutual recognition to judgments and probation decisions with a view to the supervision of probation measures and alternative sanctions

A district court having jurisdiction in the area where the person’s last permanent residence was registered in the Republic of Slovenia also has jurisdiction over all consultations under this Chapter of the Act, to provide explanations regarding the enforcement of sentences and custodial supervision measures in the Republic of Slovenia, and to make decisions on the recognition of a decision issued in a foreign State, impose an alternative sanction, a suspended sentence with custodial supervision, or a conditional sentence. If the permanent residence of a person was not registered in the Republic of Slovenia, jurisdiction shall be determined according to the place of the last temporary residence. If the court having jurisdiction cannot be determined according to the preceeding paragraph, the District Court of Ljubljana has jurisdiction.

Deadlines for the execution of the request/decision (where applicable)

A national court shall render a decision on the recognition of a foreign decision or on a refusal to recognise such decision by issuing an order within 15 days of receiving the certificate and judgment, or additional explanations. The sentenced person and the state prosecutor may appeal the order within eight days of the service of the order. A panel must decide on the appeal within 15 days. Extraordinary legal remedies against a final order are not permitted.
