Is this measure possible in your Member State under International Judicial Cooperation?

The regime of controlled or supervised deliveries is provided for in article 160-A of Law no. 144/99, of 31 August and specifically foresees that the criminal police bodies may not act in the scope of cross-border investigations, with the purpose of providing the other state with the identification and criminal accountability of a larger number of perpetrators of the offence.

The right to act and the direction and control of criminal investigation operations lie with the Portuguese authorities. The Public Prosecutor's Office in the district of Lisbon is competent to decide on requests for controlled deliveries.

Concise legal practical information

Special requirements

The criminal police bodies will intervene if the safety margins have been appreciably reduced or if any circumstance arises which makes it difficult to arrest the perpetrators or seize substances or property in the future. If this intervention has not been previously communicated to the entity that granted the authorisation, it will be communicated within the following twenty-four hours, by means of a written report. By agreement with the country of destination, when there are prohibited or dangerous substances in transit, they may be partially substituted by harmless ones, and the respective report shall be drawn up. International contacts are made through the Judicial Police, by the National INTERPOL Office.
