Is this measure possible in your Member State under International Judicial Cooperation?

There is no internal law which governs cross-border co-operation, especially cross-border hot pursuit. This subject and all the activities undertaken in this area are therefore governed by the standards of the convention for applying the Schengen Agreement to which Portugal is party.

International legal framework applicable for this measure in your Member State

Once again, it is Article 41 of the Convention implementing the Schengen Agreement that provides the cooperation mechanisms that the Member States have undertaken to observe, taking into account mutual assistance between police authorities, particularly as regards cross-border hot pursuit. Following this Convention, the Agreement between the Portuguese Republic and the Kingdom of Spain on Cross-Border Pursuit was approved and signed in Albufeira, 30 November 1998.

Concise legal practical information

Special requirements

According to Article 3 of this Agreement between Portugal and the Kingdom of Spain, cross-border hot pursuit in the territory of the other Party may take place up to 50 km from the common border or for a period not exceeding two hours from the crossing of the common border.
