    CJEU Judgments on EAW – The concept of an ‘issuing judicial authority’ (CJEUC-509/18 and C-508/18 & C-82/19) and Note from Germany

    On 27/05/2019, the CJEU’s Grand Chamber delivered its judgments in Case C-509/18 (PF) and Joined Cases C-508/18 (O.G.) & C-82/19 PPU (P.I.). In these cases, the CJEU was asked to clarify whether a Public Prosecutor’s Office may be regarded as a ‘judicial authority’ within the meaning of Article 6(1) EAW FD and whether it is as such entitled to issue a EAW.

    Exchanging criminal records: EU agrees a reformed ECRIS system

    The EU is introducing new rules to improve the way member states exchange information on convictions of third country nationals. Council and Parliament negotiators today agreed on a reformed European criminal records information system ,ECRIS, that will now include a centralised database with information on convictions of third country nationals and stateless persons ,so-called ECRIS-TCN. This provisional political agreement will now have to be confirmed by the two institutions.

    The Council today adopted a regulation on the mutual recognition of freezing and confiscation orders. The aim of the new rules is to ensure the effective freezing and confiscation of criminal assets across the EU. This will help make the EU more secure by tackling the financing of criminal activities, including acts of terrorism.
