Amsterdam District Court and Maastricht University jointly implemented a research project funded by DG Justice of the European Commission – InAbsentiEAW. The project is a comparative legal study into European Arrest Warrants (EAW) relating to persons who were not present in the proceedings leading to their conviction (in absentia proceedings). The study aims to examine arising legal issues in issuing and executing such EAWs due to varying national practices that differ considerably across the member states of the European Union. By means of case studies from Belgium, Hungary, Ireland, the Netherlands, Poland, and Romania, the problems that these countries experience in issuing and executing EAWs after in absentia proceedings are being analyzed. The project is also aiming at proposing common principles at the issuing stage of the EAW in order to avoid obstacles at the execution stage.
