Measure Implementation

Is this measure possible in your Member State under International Judicial Cooperation?

Yes, it is possible. Joint investigation teams are established in cooperation of two or more states in order to effectively investigate complicated international crime. Members of the JIT may directly request the competent authorities of another state participating on the JIT to perform specific actions of criminal proceedings without the need to send an MLA request, and such requests will be handled in the same way as actions conducted within criminal proceedings conducted in the Czech Republic. Evidence gathered by members of the JIT in another state may be used as evidence in criminal proceedings in the Czech Republic, provided that is was obtained in compliance with the law of the state, in which it was obtained, or with the law of the Czech Republic. JIT operating in the Czech Republic are always led by a public prosecutor, all members of the JIT must follow his/her instructions and are bound by the Czech law and conditions of the specific JIT agreement.
