-Framework Decision 2003/577/JHA of 22 July 2003 on the execution in the European Union of orders freezing property or evidence, which allows the judicial authority of the State of origin to adopt a decision ordering the provisional seizure/prohibition to dispose in another Member State of property that is to be subject to subsequent confiscation, is incorporated into Spanish law by Law 18/2006, of 5 June, for the effectiveness in the European Union of orders of seizure and securing of evidence in criminal proceedings and Organic Law 5/2006, of 5 June, complementary to the previous one, which amends Organic Law 6/1985, of 1 July, on the Judiciary, having been the subject of a new regulation in the Law on the Recognition of Judicial Decisions in criminal matters in the European Union of 20 November 2014 in articles 153 et seq.
-The new regulation of the European Union on the mutual recognition of orders of seizure and confiscation by provision of its article 41, once again modifies the regime applicable to seizures for the purpose of subsequent confiscation, is applicable from 19 December 2020 and replaces the provisions of the Framework Decisions 2003/577/JHA and 2006/783/JHA of the Member States of the Union with the exception of Ireland and Denmark where the Framework Decisions continue to apply, being directly applicable to all Member States from that date.
