If this area is not known, the letter of request has to be sent to the federal prosecutor's office - section of international cooperation.

Important remarks: Before the execution, the request will be translated by the Belgian prosecutor if the language is not the language of the judicial area where the request must be executed. It is recommended, when possible, to obtain, prior to sending the request, information about the use of the correct language.

The deadlines as foreseen in the EIO Directive are applicable.

a. Special requirements Authorisation for an observation with a beacon/tracker has to be given before the border crossing. Autorisation after the fact is not possible according to Belgian Law. b. Other useful information If afterwards, it is discovered that the vehicle has been on Belgian territory (based on an analysis by the beeper's data), it is possible to request a posteriori the authorization to use the data in the criminal investigation of the requesting state. The letter of request has to be sent to the local public prosecutor of the place of entry on the Belgian territory or to the federal prosecutor if this area is not known as soon as the presence of the vehicle on the Belgian territory has been discovered.
