Is this measure possible in your Member State under International Judicial Cooperation?

The following definition of hot pursuit is established in the national legislative act The Regulation on Cross-border Hot Pursuit: Cross Border Hot Pursuit – the continuation of the pursuit of a person caught in the act or participating in a criminal act, the commission of which may be the basis for his extradition or the issuance of a European arrest warrant, or who has escaped from the place of temporary detention or punishment, by the officers of the authorized institutions of one State on the territory of the other State of the Contracting Parties.

International legal framework applicable for this measure in your Member State

Convention Implementing the Schengen Agreement. The Regulation on Implementation of the Cross-Border Hot Pursuit, approved by the Order of the Lithuanian Police Commissioner General and the Commander of the State Border Guard Service (SBGS) under the Ministry of the Interior of the Republic of Lithuania, 28 November, 2007 No 5-V-782/4-1072 (hereinafter – the Regulation on Cross-border Hot Pursuit).

Competent Authority

Command and Coordination Board of Police Department under the MoI, whose officers coordinate the operations on 24/7 basis, is the central unit of the Republic of Lithuania, responsible for coordination of cross-border hot pursuit operations. Hot pursuits are conducted by the Police and State Border Guard Service officers.

Execution deadline

Deadlines for the execution of the request/decision (where applicable)

According to the Governmental Agreements between Latvia and Poland, cross-border hot pursuit in the territory of Latvia or Lithuania can be continued no longer than 1 hour from the moment of crossing the border. The Governmental Agreements between Lithuania and Poland establishes that cross-border hot pursuit on the territory of Poland or Lithuania can be continued no longer than 1 hour from the moment of crossing the border and no further than 100 kilometres from the common border of the State.

Special requirements

Cross-boorder hot pursuit might be implemented only crossing the borders of bordering Schengen Countries.
