International legal framework applicable for this measure in your Member State

The MLA 1959 Convention with its Second Protocol and the MLA 2000 Convention as supplemented by bilateral agreements in force (with Austria, Czech Republic and Slovak Republic, Germany.

Competent Authority

In principle, procedural documents shall be sent directly by post. If this way of procedure is not feasible, competent authorities are: Circuit Prosecutor´s Office (Prokuratura Okręgowa) – for the pre-trial stage; District Court (Sąd Rejonowy) – for the trial stage; Ministry of Justice Department of International Cooperation and Human Rights acting as the central authority. The National Prosecutor’s Office Bureau of International Cooperation can also be addressed – in the pre-trial stage.

Polish. English and French are also acceptable.

No deadlines. Requests in urgent cases shall be marked as urgent.

Special requirements

The requests and other documents being transmitted shall be accompanied by a translation into the Polish language or into English or French; the translation of the documents which are to be transmitted is not necessary if the transmission has the form of a simple service. In other cases they shall be translated into the Polish language if the receiver is a Polish national or if his/her permanent residence is in Poland. Where there is a reason to believe that the addressee does not understand the language in which the document is drawn up, the document, or at least the important passages thereof, must be translated into Polish in the territory of which the addressee is staying. If the authority by which the procedural document was issued knows that the addressee understands only some other language, the document, or at least the important passages thereof, must be translated into that other language.
