Notification and implementation by Germany of the Directive amending the Framework Decision as regards the exchange of information on third-country nationals and as regards the ECRIS

A draft bill implementing the Directive is being prepared by the Federal Ministry of Justice together with the Ministry of the Interior.

It has been fully implemented – additional articles were added (in force as of 24/12/2021) in Ordinance № 8 from 26.02.2008 on the functions and the organisation of the activity of the criminal records offices.

The Directive has been transposed to Criminal Records Database Act.

Directive is in the stage of implementation. Amendments in the Punishment Register Law has been approved in the second reading in the Parliment on 24.03.2022.

Transposed by Law n.º 14/2022, 02 of August.

This law also made adjustments to the following laws and decrees: 

• Law n.º 37/2015, 05 May;
• aw Decree n.º 171/2015, 25 August.

Legislation process has been completed by the adoption of the Act No. 130/2022 Coll., amending the Act No. 40/2009 Coll., the Criminal Code, the Act No. 45/2013 Coll., on Victims of crime and some other Acts. The Act No. 130/2022 Coll. entered into force on 28 June 2022.
