Under the Romanian Presidency on 26-28 June in Bucharest, Romania, took place the 52nd Plenary meeting of the European Judicial Network.
The meeting gathered around 135 participants: EJN Contact Points from the EU Member States, candidate, associated and third countries, members of the EJN Romanian Judicial Network in criminal matters, EJN partners, as well as representatives from Eurojust, the European Commission and the General Secretariat of the Council of the EU.
During the two days EJN plenary meeting the Contact Points were informed on a variety of topics such as the complementarity means and goals of the EJN & EUROJUST, the Romanian legal and institutional framework for international judicial cooperation in criminal matters, the European Commission initiatives in relation to e-evidence.
Participants debated on the role of the EJN in the application of the EU Mutual Recognition Instruments. In three parallel workshops actively discussed the EIO, EAW and on Future relations between the EJN and the EPPO as follows:
- European Investigation Order: article 14 of the EIO directive, the question of legal remedies in relation to the opinion of the advocate general in the pending case at the CJEU – C-324/17. Moreover, it was debated how the term interception is interpreted in the Member States and the consequences of this for the application of Article 31 of the EIO Directive.
- European Arrest Warrant: focused mainly on the judgments of the CJEU in Joint Cases C-508/18 and C-82/19 PPU and Case C-509/18 PF, whether a public prosecutor’s office is a “judicial authority” within the meaning of Article 6(1) of EAW FD. The EJN Contact Points discussed the impact of the judgments in the Member States. In addition, they discussed the requirements for detention conditions in light with Opinion of the Avocat General on Case C-128/18 (Dorobanțu Case) as well as recent practices with regards to the assessment of the detention conditions in EAW surrender procedures.
- Future relations between the European Prosecutor’s Office and the EJN: the EJN discussed together with the representatives of the European Commission and other partner Networks how the EJN could facilitate the investigation of cases within the competence of the EPPO.
