Is this measure possible in your Member State under International Judicial Cooperation? | In national procedure the State Attorney or the police may check the alibi and other important facts for the institution and conducting of the criminal proceedings by means of a telephone link that allows a simultaneous communication to the interrogated persons (telephone conference). The recording of the telephone conference may be used as evidence in criminal proceedings if the defendant was previously instructed on his rights and if the defence counsel was present when the defendant was interrogated.

Special requirements | When affording mutual legal assistance, domestic judicial authority shall comply with the formalities and procedures expressly indicated in the request as necessary pursuant to the law of the requesting state, unless provided otherwise by an international treaty and provided that such formalities and procedures are not contrary to the principles of the domestic legal order. authorities
