1996 Extradition Convention - into force on 5 November 2019

The Convention of 27 September 1996 relating to Extradition between the Member States of the EU will enter into force on 5 November 2019

The Convention of 27 September 1996 relating to Extradition between the Member States of the EU (OJ C 313, 23.10.1996, p. 12, retrievable here) will enter into force on 5 November 2019 (OJ C  329, 1.10.2019, p 2, retrievable here)

 

With the deposit by Italy of its notification on 7 August 2019, all EU Member States that drew up the 1996 Convention have now completed the required formalities for the entry into force of this instrument in accordance with Article 16 of that Convention.

 

Considerations on the scope of application of this Convention for extradition between the EU Member States and Switzerland/Liechtenstein

While surrender among the EU Member States, and between the EU Member States and Iceland and Norway, are governed by instruments that have been adopted subsequently to the 1996 Extradition Convention (2002 EAW FD and 2006 EU-IS-NO Surrender Agreement), the entry into force of the 1996 Extradition Convention is still relevant for extradition between the EU Member States and Switzerland/Liechtenstein.

Switzerland notified the Council that it had taken the necessary measures to be bound by the 2004 Agreement between the EU and the Swiss Confederation on the implementation, application and development of the Schengen acquis.

Liechtenstein notified the Council that it had taken the necessary measures to be bound by the 2008 Protocol between the European Union, the Swiss Confederation and the Principality of Liechtenstein on the implementation, application and development of the Schengen acquis.
