1. MEASURE IMPLEMENTATION

Is-Slovenja

Is this measure possible in your Member State under International Judicial Cooperation?

Yes. Before the interrogation, the accused must be acquainted with the criminal offence he is suspected of having committed and with the grounds of the suspicion. The accused need not defend him or answer questions, but may use silence as a defence. If the accused so desires, his counsel (lawyer) may attend the interrogation. In certain cases the presence of counsel (lawyer) is obligatory (in the procedure to determine detention; at each interrogation if the accused is already in custody; if the accused is mute, deaf or otherwise incapable of defending himself successfully; if criminal proceedings are for an offence punishable by 30 years imprisonment). If the accused does not understand Slovenian, an interpreter is ensured for him at the interrogation.
