1. MEASURE IMPLEMENTATION

Is-Slovenja

Is this measure possible in your Member State under International Judicial Cooperation?

Yes. Persons under sixteen years of age are usually summoned as witnesses via their parents or legal representatives. The interrogation of a minor, especially if the minor is the victim of a crime, must be conducted with considerateness to avoid upsetting his state of mind. The accused must not be present at the interrogation of an injured minor (victim of sexual abuse). The interrogation may also be conducted in the presence of an expert attending on the judge (depending on the level of mental development of the witness). It must proceed in an appropriate manner and can be recorded with a sound or visual recording device.
