Is this measure possible in your Member State under International Judicial Cooperation?

The applicable law is the Criminal Procedural Act, which refers to this measure for national cases. In Spain the restitution is a civil measure wich is normally dealt with in the framework of the criminal proceeding. The restitution could be delayed if the objet is needed as evidence in the national proceedings.
