Transfer of proceedings (1001) 1. MEASURE IMPLEMENTATION |
Is this measure possible in your Member State under International Judicial Cooperation? | According to the Act on mutual legal assistance in criminal matters, on the request of a foreign judicial authority, the domestic judicial authority may take over carrying out criminal proceedings for a criminal offence committed abroad when extradition is not allowed, and if a foreign judicial authority stated that if shall not further criminally prosecute the prosecuted person after the final decision of the domestic judicial authority. If a foreigner domiciled in a foreign county committed an offence in the territory of the Republic of Croatia, criminal prosecution may transferred to that country, provided he or she does not object thereto. Criminal prosecution may be surrendered for offences with prescribed punishment up to ten years of imprisonment

4. ACCEPTED LANGUAGES |
Accepted languages for the request/decision | Letters rogatory for mutual assistance and annexed documents shall be accompanied by a translation into the Croatian language or, if not possible, into the English language.

5. EXECUTION DEADLINE |
Deadlines for the execution of the request/decision (where applicable) | If the injured party is a Croatian national, surrender is not allowed if he objects thereto, unless security for realization of his property-related claim was deposited. If the prosecuted person is in detention, the foreign state shall be requested to answer within the latest of fifteen days whether it surrenders criminal prosecution.
