Is this measure possible in your Member State under International Judicial Cooperation?

Yes. Hot pursuit in Norwegian territory should as a rule be carried out by the Norwegian police. However in the frame of the Schengen Convention this measure is possible. NOTE: This measure is regulated in detail in the "Schengen police cooperation handbook", issued by the COUNCIL OF THE EUROPEAN UNION on the 11th of July 2007, ref. 10694/07 ENFOPOL 121 COMIX 553. Furthermore the Schengen police cooperation handbook has been updated 14th of December 2009 ref. 10505/4/09 ENFOPOL 157, ENFOCUSTOM 55, CRIMORG 90 and COMIX 465. Reference is also made to the "Schengen catalogue" of 15th of March 2011: "Best practice and recommendations for police cooperation in the Schengen area".

2. LEGAL FRAMEWORK

International legal framework applicable for this measure in your Member State

The Schengen Convention article 40 and 41. Furthermore there is an agreement between the police in Finland, Sweden and Norway (in force on 1 of January 2003) implementing the Schengen art. 40 and 41. The agreement states contact points in the countries, use of standardised templates for judicial cooperation, surveillance and pursuit and practical arrangements.

3. COMPETENT AUTHORITY TO:

Requests from the competent authorities in the Nordic countries: the request is made to the Norwegian police. The request should be forwarded via Interpol, Kripos (NCIS – National Crime Investigation Service – The National Police Unit), Oslo, Norway. "Desken" is operational 24/7. Requests from other European Union countries (other than Denmark, Sweden and Finland) and countries which have ratified and implemented the Coe 1959 Convention on Mutual Legal Assistance in Criminal Matters. The requests for judicial cooperation should be forwarded to the regional prosecutors in Norway. To ensure operational and effective response, the requests for judicial cooperation in cross-border observation cases, may also be facilitated via Europol and/or Eurojust., The Interpol channel may serve as an alternative way of communicating the request for judicial cooperation. b. Other useful information

Any foreign police personnel must adhere to national Norwegian law when operating in Norwegian territory. Foreign police personnel must be able to identify themselves at all times. Furthermore they must at all times be able to document their permission to carry out the cross-border hot pursuit.
