Is this measure possible in your Member State under International Judicial Cooperation?

The rules concerning Identification parades are found the in Administration of Justice Act’s chapter 75 a. The measure is allowed provided a series of requirements are met.

The Convention of 29 May 2000 on Mutual Assistance in Criminal Matters between the Member States of the European Union.

Denmark will receive requests in Danish, Norwegian, Swedish or English but will also receive requests in French and German although translation may be done at sending states expense.

6. CONCISE LEGAL PRACTICAL INFORMATION

a. Special requirements

A so-called ‘direct confrontation’ - that being a suspect displayed to a person outside the police - may only the conducted when the following requirements are met: - The individual must on reasonable grounds be suspected of an offence, which is prosecuted by the State, and - The measure must be presumed to be of significant importance to the investigation. - The investigation must concern a criminal action that is punishable by at least 1 year and six months of prison. A direct confrontation may be conducted in instances where the requirements above are not met, provided that the suspect gives his or her express consent to the measure. Where possible this consent must be written. A direct confrontation must never be conducted where the purpose of the confrontation, the significance of the case and/or the discomfort of the accused are/is disproportionate with the investigative value of the measure.
