Judicial cooperation
General description of the national system for international judicial cooperation in criminal matters
Albania belongs to the continental system of law and as a result it is based on written laws. However, the legal framework is reinforced by the judicial precedent.
The Constitution of Republic of Albania guarantees the due criminal legal process as one of the fundamental individual rights, also expressly acknowledging the inviolability of essence of these rights under the European Convention of Human Rights.
All international Conventions and Agreements, after ratification by law, become part of the domestic legal system and prevail over the domestic law in case of conflict or incompatibility.
Ministry of Justice is the central authority assigned for the implementation of Council of Europe Conventions and UN Conventions to which Albania has acceded.
The Department of Jurisdictional Foreign Relations at the Ministry of Justice is responsible to deal with and follow all requests for international judicial cooperation.

Information on the organisation of the EJN
Albania has nominated two representatives to the EJN who are the Albanian EJN Contact Points. Namely one representative is Prosecutor Head of Foreign Jurisdictional Directory at the Albanian General Prosecution Office (GPO); the other representative is Head of Department of Foreign Jurisdictional Relations at the Albanian Ministry of Justice (MOJ) part of the Albanian Government.
