(b) Controlled deliveries are regulated by the Suppression of Crime (Controlled delivery and other specific provisions) Law of 1995 (L. 3(I)/1995) which provides for the controlled delivery of weapons etc and gives under certain circumstances the authority to the Chief of Police and the Director of Customs and Excise Department or both of them acting in common to apply such a method, pursuant to prior notice of the Attorney General of the Republic who is allowed to give any necessary orders/instructions. Section 5 of the above mentioned law provides that a controlled delivery in cooperation with other states may take place only pursuant to mutual agreements or arrangements purporting to the identification of persons involved in the stated offences provided for in Section 3, with a view to the adoption of legal proceedings against them. In the absence of the above mentioned mutual agreement or arrangement with another state, Section 5, para. 3, provides for an alternative procedure under which a controlled delivery may after all take place.
