1. MEASURE IMPLEMENTATION

Is this measure possible in your Member State under International Judicial Cooperation?

At the request, requested Party may grant permission for the controlled delivery of objects coming from crime or intended for the commission thereof, if otherwise determine the participants in the act or detection of distribution routes would be impossible, or very difficult. Authorization may be granted subject to certain conditions. Consent shall be in accordance with the domestic law of the requested Party. The Requested Party may refuse or limit per consignment implicitly supervised especially when it involves a particular danger to the life or health of persons or the environment. If there is no other way to determine the persons involved in the crime or if their determination would otherwise be difficult competent authority of a Contracting Party may apply to the competent authority of the other Contracting Party with a request for secret supervision of import, export and transport of items coming from crime or used to it was committed. These objects may be in particular narcotic drugs and psychotropic substances, weapons, explosives, false means of payment, securities, financial resources and objects from the crime. Contracting Party may refuse or limit permission to secret supervision of shipments especially when it involves a particular risk for people involved in the project, to the population or the environment.

1.The Agreement (Article 21) of the Government of the Republic of Poland and the Government of the Federal Republic of Germany on the cooperation of police , border guard and custom forces signed in Zgorzelec 15 May 2014 (Dz.U.of 2 July 2015, poz.939) 2. The Agreement between the Republic of Poland and the Slovak Republic on cooperation in the border regions and on combating crime, signed in Warsaw on 23 March 2004 (Dz. U. 07.85.568), amended by an Agreement on 12 May 2010. 3.The Agreement (Article 14) between the Republic of Poland and the Republic of Lithuania on cooperation in combating organized and other crime and cooperation in border regions signed in Vilnius on 14 March 2006 (Dz.U.07.177.1244). The issue of controlled delivery is governed by some other internal rules which, due to the confidential nature may not be published.
