1. MEASURE IMPLEMENTATION

Is this measure possible in your Member State under International Judicial Cooperation?

The person directing criminal proceedings, not executing statutory seizure, is entitled to request in a written form from physical and legal persons objects and documents relevant to a criminal proceedings. If physical and legal persons do not submitt requested objects and documents in the set term, the person directing criminal proceedings executes seizure or search. Moreover, upon the request of the person directing criminal proceedings heads of legal persons have the duty within the scope of their competence to execute documentary auditing, inventory, official examination. The confidential information at the disposal of credit institution shall be provided: - to courts - on the basis of court's decision based on the case at the court; - to investigation bodies - at the pre-trial stage on the basis of the request of the head of investigation body, that is accepted by a judge of a district (city) court; - to prosecutor's office - at the pre-trial stage on the basis of the request of a prosecutor, that is accepted by a judge of a district (city) court. Public authority or public official requests the necessary information in a written form indicating in the request precise name and amount, as well as basis for requesting the information - the respective regulatory enactment, international agreement or a regulatory enactment of the EU. In case of the request for information of accounts and transactions of physical and legal persons in the request it should be indicated that a credit institution is not entitled to inform its customer and third parties about receipt of such a request, as well as on the basis of which law and international agreement this prohibition is set.

Convention on Mutual Assistance of the European Union Member States in Criminal Matters, adopted by the Council on 29 May 2000 in accordance with Article 34 of the Treaty on the European Union. Convention Nr.30 on Mutual Assistance in Criminal Matters adopted by the Council of Europe on 20 April 1959.

Section 853 of Criminal Procedure Law "Performance of Special Investigative Actions" A special investigative action shall be performed on the basis of a request of a foreign state only in a case where such operation would be admissible in criminal proceedings taking place in Latvia regarding the same offence.
