Is this measure possible in your Member State under International Judicial Cooperation? | Yes, it is possible. The person who is collaborating with the inquiry may be heard as a witness.
If there are reasonable grounds to suspect that a criminal offence has been committed, the prosecutor or the investigating authority (with the permission of the prosecutor) may terminate the investigation if the person who may be reasonably suspected of having committed the criminal offence co-operates in proving the case or another criminal offence to such an extent that the interests of national security or law enforcement take priority over the interest to enforce the claim of the state under criminal law. (See Paragraph (1) of Section 192 of Act No XIX of 1998 on Criminal Proceedings) |
