Is this measure possible in your Member State under International Judicial Cooperation?

Yes, it is possible. Upon the request for mutual legal assistance submitted by a foreign authority, the witness or the expert may be heard by the court via a closed-circuit communication system.

The court is entitled to receive this type of request. Jurisdiction of the competent court shall be defined according to the place of residence (or detention) of the person to be heard as witness.

Only the court has competence to execute the measure.

A translation of the request for assistance and documents annexed thereto into either Hungarian, or any of the official languages of the Council of Europe, will be required, if they are not drawn up in these languages.

a. Special requirements

Technical requirements that are necessary for establishing the link and ensuring compatibility must be provided in the request. Any caution or notification of rights should be given to the person concerned must be included in the request.

b. Other useful information

According to the Hungarian law the following persons may only be presented in the court room during the hearing of a witness via videoconference: the judge fulfilling the MLA request, the lawyer acting on behalf of the witness, in the case of a minor witness the legal representative or guardian thereof, and if required, the expert, the interpreter and the staff operating the live link. It is possible to execute the measure in conformity with the procedure applicable in the requesting/issuing state if it is not against public order.
