Is this measure possible in your Member State under International Judicial Cooperation?

Yes. Persons summoned as witnesses are bound to respond to the summons, to tell the truth and to disclose all they know concerning the criminal case about which they are interrogated. Before interrogation, the witness must be instructed that he/she is not bound to give answers that would tend to bring disgrace upon him/her or his/her near relatives or considerable material damage or involve him/her in criminal prosecution. In certain cases a person may not be interrogated as a witness (persons obliged to keep military or official secrets, until absolved of the obligation; counsel for the accused) or may decline to testify (relatives of the accused; father confessor; persons bound to keep secret the information they have come by in exercising their profession (lawyers, doctors, psychologists... ).

According to national legislation, state prosecutor, accused person and defence counsel may be present when hearing a witness. Injured party may be present when hearing a witness only if it is likely that witness will not attend trial. Representatives of requesting state may be present if they are in the same function, if an international treaty does not provide otherwise. Representative of the authority competent for carrying out the hearing in the requesting country may also be present.
