Execution of a Supervision Measure (905) 1. MEASURE IMPLEMENTATION |
Is this measure possible in your Member State under International Judicial Cooperation? | Yes.
a) the recognition in Greece of a decision on supervision measures issued in another EU Member State as an alternative to provisional detention, b) the supervision of measures imposed on a natural person, and c) the surrender of the person concerned to the issuing State in case of breach of these measures. (Article 41 of Law 4307/14)

2. LEGAL FRAMEWORK |
International legal framework applicable for this measure in your Member State | Council Framework Decision 2009/829/JHA of 23 October 2009 on the application, between Member States of the European Union, of the principle of mutual recognition to decisions on supervision measures as an alternative to provisional detention as implemented by Part c of Law 4307/14

3. COMPETENT AUTHORITY TO: |
* receive the request/decision for judicial cooperation | The competent authority for the recognition of the decision and the monitoring of the supervision measures, where Greece is the executing State, shall be the Public Prosecutor of the First Instance Court of the place of ordinary residence of the person in respect of whom the decision on supervision measures has been issued (Article 43 par. 1 of Law 4307/14)
| * execute/recognise the measure (if other than the receiving authority) | The Public Prosecutor of the place of the supervised person’s ordinary residence shall recognize the decision forwarded in accordance with Article 45 and without delay and take all necessary measures for monitoring the supervision measures. Recognition shall take place as soon as possible and in any case within twenty (20) working days of receipt of the decision on supervision measures and the relevant certificate. (Article 50 par. 1 of Law 4307/14)
If a legal remedy has been introduced against the decision on supervision measures, the time limit for recognition of the decision on supervision measures shall be extended by another twenty (20) working days ( Article 50 par. 2 of Law 4307/14) |
