Is this measure possible in your Member State under International Judicial Cooperation?

Yes. A group of persons which is formed in order to conduct investigation in one or more European Union Member States, especially when a) the investigation requires difficult and complex actions involving other Member States and b) the nature and complexity of the case calls for the taking of coordinated and concerted action in the Member States concerned.



International legal framework applicable for this measure in your Member State

COUNCIL FRAMEWORK DECISION of 13 June 2002 on joint investigation teams (2002/465/JHA) as implemented by articles 13 and following of Law 3663/2008 as article 13 was amended by article 62 of Law 4249/2014

The Greek competent authority for the receipt of the said request and for entering into said written agreement is the Public Prosecutor at the Court of Appeal having the territorial jurisdiction. If the investigation is to be conducted in the judisdictions of more than one Courts of Appeal, then the competent authority is the Public Prosecutor at the Supreme Court. (Article 15 par.2 of Law 3663/2008)

A joint investigation team operates within the Greek territory under the leadership of the representative of the competent Greek authorities, who are appointed by the competent Public Prosecutor at the Court of Appeal having the territorial jurisdiction or the Public Prosecutor at the Supreme Court. The leader of the team acts within the limits of jis jurisdiction, according to the Greek law and under the supervision of the competent Public Prosecutor, who also makes the necessary organisational arrangements as required for the operation of the team.

a. Special requirements

Joint investigation teams can be formed only for the offences of: terrorism, counterfeiting of currency and circulation thereof, forgery, arson, forest arson, explosion, offences related to explosive substances, causing of a shipwreck, poisoning of water and food, impairing the safety of railroads, ships and aircraft, kidnapping, trafficking in human beings, abduction of minors, rape, sexual exploitation of children, child pornography, aggravated theft, embezzlement, robbery, extortion, fraud, computer theft, facilitation of unauthorised entry and residence with the aim of profit committed by two or more individuals, illicit trafficking in narcotic drugs and psychotropic substances as well as for felonies related to the legislation on guns, explosive substances and protection from materials radiating harmful radiation and the legislation on the protection of antiquities and the cultural heritage in general.

b. Other useful information

The agreement should specify at least the following information: a) the parties to the agreement, b)the purpose for which the joint investigation team is being set up, c) the period within which the investigation is to be conducted, d)the Member State (s) of which the joint investigation team is to operate, e) the leader of the joint investigation team, f) the persons who will be the members of the joint investigation team, g) the terms of reference of the joint investigation team and h) various organisational arrangements.
