Enforcement of a Financial Penalty (902) 1. MEASURE IMPLEMENTATION |
Is this measure possible in your Member State under International Judicial Cooperation? | The Criminal Justice (Mutual Assistance) Act 2015 which transposes Council Framework Decision 2005/214/JHA and other measures was enacted on 1 December 2015. This measure will be possible in early 2016 once the relevant commencement order is signed. Under the provisions of the Criminal Justice (Mutual Assistance) Act 2008 (as amended) the Minister for Justice & Equality is the central Authority for mutual assistance requests. The Minister may delegate these functions to a person or persons. In the case of the Framework Decision 2005/214/JHA on mutual recognition of financial penalties it is probable that these functions will be delegated to the Courts Services. |
