Poursuite transfrontalière (802) 1. MEASURE IMPLEMENTATION |
Is this measure possible in your Member State under International Judicial Cooperation? | This measure is possible only within the framework of Police cooperation, not within International Judicial Cooperation (the measure is not about gathering of evidence but an arrest of a person). It allows foreign Police authorities to continue pursuing a perpetrator who crossed the Czech state borders. The foreign authority must immediately inform Czech authorities after crossing the border and terminate the pursuit immediately after being instructed to do so by Czech authorities. European Arrest Warrant must be sent immediately after apprehending the pursued person (the international treaties - the SIT or bilateral ones - can stipulate the time limit for a delivery of the EAW).

6. CONCISE LEGAL PRACTICAL INFORMATION |
a. Special requirements | Consent of judicial authorities (i.e. public prosecutor or court) is not required. The foreign police officers are obliged to comply with the law of the Czech Republic. They are not entitled to enter residences or other areas not accessible to general public. They are entitled to apprehend and secure the pursued person and to check, whether the person is not armed in cases where Czech authorities are not yet present.
