Is this measure possible in your Member State under International Judicial Cooperation? | Yes. Specific rules for the hearing of the persons collaborating with the inquiry are established in order to protect them from possible criminal impact. The witness on whom the measures of protection from the criminal impact are applied can be examined using measures of sound and video distance transmission. In order to protect a witness from criminal impact anonymity can also be applied on him. The pre-trial judge may hold that questioning should take place in the absence of the defence counsel and the suspect in the place of questioning. In such a case, the pre-trial judge must provide access to the defence counsel and the suspect to the testimony after the questioning of the person. A prosecutor may take part in the questioning of the victim or the witness whose identity is not disclosed.
