Is this measure possible in your Member State under International Judicial Cooperation? | Yes. Section 63 of the Criminal Justice (Mutual Assistance) Act 2008 sets out the standard procedure for hearing witnesses in the State and taking their evidence for use in proceedings in another country (See Measure 702). The Second Schedule to the Act provides that a person will not be compelled to give evidence in proceedings that the person would not be obliged to give in criminal proceedings in Ireland. Under Section 27 of the Criminal Evidence Act 1992 the evidence of a person under 14 years of age may be taken without oath or affirmation if the court is satisfied that the person is capable of giving an intelligible account of events which are relevant to the proceedings. |
