Is this measure possible in your Member State under International Judicial Cooperation? | Yes.
An order to produce documents may arise in proceedings under S.63 of the Criminal Justice (Mutual Assistance) Act 2008 which provides for the taking of evidence in Ireland for use outside the State.
"Evidence" includes documents and other articles.
Section 74 (search) and 75 (production order) enables the Government to designate countries to which its provisions will apply. Documents can be obtained under S.74 or S.75.
Section 75 (production order) allows a court to authorise An Garda Siochana (Irish Police Force) to obtain specified documents which are relevant to an investigation outside the State. |
