Is this measure possible in your Member State under International Judicial Cooperation? | According to the Act on mutual legal assistance in criminal matters, domestic judicial authorities may, without prejudice in any way to their own investigations or proceedings and subject to condition of reciprocity, without prior request, forward to the competent foreign judicial authorities information obtained within the framework of their own investigations, which relate to criminal offences or breach of the rule of law in misdemeanour proceedings brought by the administrative authorities, in respect of acts which are punishable under the Croatian law by pecuniary fine, and where in such proceedings the decision of the administrative authority may give rise to proceedings before a court having subject matter jurisdiction in criminal matters, when they consider that the disclosure of such information might assist the receiving state in initiating or carrying out investigations or court proceedings or might lead to a request for mutual assistance by that state. Domestic judicial authority shall request from the foreign judicial authority to which it transmitted the information, the communications on any action undertaken upon such information, as well as transmission of issued decisions, and it may also impose other conditions for the use of such information at the receiving state. Spontaneous exchange of information is also foreseen in bilateral and multilateral agreements.
