International legal framework applicable for this measure in your Member State

Directive 2011/99/EU of the European Parliament and of the Council of 13 December 2011 on the European protection order, implemented by Legislative Decree 11 February 2015 (that entered into force on 10.03.2015).

3. COMPETENT AUTHORITY TO:

Italia

* receive the request/decision for judicial cooperation

The Ministry of Justice shall receive and transmit the protection measures and the European protection orders to the Judicial Authority.

* execute/recognise the measure (if other than the receiving authority)

The recognition of a European protection order shall be decided by the Court of Appeal in whose district the protected person has declared he or she has his/her whereabouts or residence or where the person has declared his/her intention to have his/her whereabouts or residence, when the request was made.
